To consider a report by the Licensing Officer regarding an application for premises licence for the Henry Cort Community College, Hilson Drive, Fareham PO15 6PH. Additional documents:
Minutes: At the invitation of the Chairman, the Panel was joined by the following persons:
Mrs C Cubbage, Principal at Henry Cort Community College. Mrs M Gunn, Business Manager at Henry Cort Community College.
The Panel had before it a report by the Licensing Manager regarding an application for new premises license in respect of Henry Cort Community College, Hillson Drive, Fareham PO16 6PH. In accordance with the Licensing Act 2003, a copy of the hearing procedure for the consideration of the application had been made available to all parties at the meeting.
The Panel considered the application in accordance with the agreed hearing procedure.
The Chairman of the Licensing Panel outlined the procedure to be observed and introduced the Panel Members, Officers and Interested Parties.
The Licensing Officer presented a summary of the application and the representations received.
The Panel was given the opportunity to seek points of clarification on the summary presented by the Licensing Officer.
At the invitation of the Chairman, the Applicant joined the meeting to answer questions and provide points of clarification on the application.
All parties were given the opportunity to make a closing statement.
The Licensing Panel then deliberated in private on the application. Having considered the application and the written representations made, the Chairman advised that the decision of the Panel was as follows:-
RESOLVED that the application for a new premises licence be granted.
DECISION OF THE LICENSING PANEL REGARDING APPLICATION FOR NEW PREMISES LICENSE - HENRY CORT COMMUNITY COLLEGE, HILLSON DRIVE, FAREHAM
The Panel has considered very carefully the application for a premises licence at Henry Cort Community College, Hillson Drive, Fareham. It has paid due regard to the Licensing Act 2003, statutory guidance and the adopted statement of policy. Human rights legislation has been borne in mind whilst making the decision.
All representations, both written and given orally today, have been taken into consideration. It was noted that no representations had been received from any of the Responsible Authorities.
In light of all of the above, the Panel has determined to grant the application in the terms sought, save for the fact that a licence is not required for the hours sought for late night refreshments.
REASONS The Panel did consider very carefully the written representations from concerned residents. Most residential concern related to late night noise or noise generally from amplified sound at the premises.
The Panel accepted legal advice that other concerns- including parking, traffic, effects on wildlife etc. cannot be taken into account.
The premises have had the benefit of a premises licence since 2005 allowing all of the licensable activities now sought save for the sale of alcohol.
The Panel heard from the applicant that comedy nights, no more than twice a month, are anticipated. These events will be limited to 200 attending and will be ticket only events i.e. not open to the wider general public.
In light of this proposed activity the Panel determined that it would not be appropriate to limit the licence or refuse the licence at this time.
Residents should, however, be reassured that there is the ability to commence a review of the premises licence at any time where evidence shows that issues arise and are relevant to the licensing objectives.
There is a right of appeal to the Magistrates Court for all parties. Formal notification of the decision will set out that right in full.
