Exclusion of the Public and Press

To consider whether it is in the public interest to exclude the public and representatives of the press from the remainder of the meeting in accordance with Section 100(A) of the Local Government Act 1972, on the grounds that the matters to be dealt with involve the likely disclosure of exempt information as defined in Paragraphs 1, 2 and 3 of Part 1 of Schedule 12 of the Act.

Minutes:

RESOLVED that the public and representatives of the press be excluded from the remainder of the meeting in accordance with Section 100(A) of the Local Government Act 1972, on the grounds that the following matters to be dealt with involve the likely disclosure of exempt information as defined in Paragraphs 1, 2 and 3 of Part 1 of Schedule 12 of the Act.

Review of Personal Licence

To consider a report by the Licensing Manager, which contains exempt information, on a review of a personal licence.

The Panel considered a report by the Licensing Manager which contained exempt information in respect of a personal licence. A copy of the report was circulated to Members with the agenda.

 

The Panel received advice from the Council’s Legal Representative in respect of a correction to paragraph 7 of the report to the effect that the Panel is obliged to consider the matter in accordance with both the Licensing Act 2003, amending secondary legislation and the rules of natural justice.

 

The Licensing Officer reported regarding the case as information received required that the personal licence be reviewed by the Panel.

 

At the invitation of the Chairman and in accordance with the Council’s standard procedure for the review of personal licences, the Licence holder addressed the Panel regarding the matter at hand and answered questions thereon.

 

Following the submission of the applicant’s representation, the Licence holder, the Licensing Manager and the Licensing Officer withdrew from the meeting whilst the Panel considered its decision.

 

After the Panel’s deliberations, all parties were recalled to hear the Chairman announce the Panel’s decision.

 

RESOLVED that the decision regarding the personal licence be deferred until the Panel is able to reconvene to consider any representation made by a relevant authority.
